Freedom-to-operate and prior art search

Know which third-party rights could stand in your way and what already exists – before you commit time and budget.

A prior art search shows what is already known about a technical solution, in patents and in the literature. A freedom-to-operate (FTO) search checks whether active third-party rights in your target markets could affect a planned product or process. We carry out both searches and analyse the results from an engineering perspective. The legally binding assessment, such as an FTO opinion, is provided by a patent attorney; our results are its basis.

How we work

  1. Describe the subjectWith your engineers we describe the solution so that its relevant technical features can be searched.
  2. Define the search strategyClassifications, keywords, countries and – for FTO – the legal status to be considered.
  3. SearchPatent databases and, for prior art, scientific literature and conference proceedings.
  4. AnalyseEngineers read the relevant documents and compare claims with the features of your solution.
  5. Document and hand overFindings with publication numbers, technical assessment and open points for your patent attorney.

Limits you should know

No search can guarantee that no relevant right exists. Patent applications are usually published eighteen months after the priority date, so very recent filings are not yet visible. We document the scope and limits of every search.

Frequently asked questions

Does your search replace an FTO opinion?

No. A legally binding freedom-to-operate opinion is provided by a patent attorney. We deliver the technical search and analysis it can build on.

Which countries does an FTO search cover?

The countries where you intend to manufacture, sell or use the product. We agree the selection at the start because it determines effort and validity.

What does it cost?

Mainly the number of technical features, the number of countries and the depth of analysis. We scope the project after the briefing and quote a fixed price.

Clarity before you develop or launch?

Describe the solution and your target markets. We will come back with search scope and a fixed price.
